Report biofuels fraud

If you see something, say something.

The EBB Whistleblower Tool allows for a confidential and easy reporting of allegations of fraud or non-compliance of the RED.

All information will be investigated by authorised staff of the EBB or its law firm, shortly after it is received.

Fraud should be prosecuted. The objective is for us to gather proof and inform the relevant verification schemes and (national) authorities so that non-compliance is sanctioned.

Our proposal to reform EU biofuels verification

In its continued effort to tackle biofuels fraud, the EBB has published an elaborate and ambitious proposal revising the rules on sustainable biofuels verification.

Some highlights

  • Rules that apply to domestic producers, should be enforced just as strictly outside of the EU, for biofuels used on the EU market.
  • Every producer should report the quantities, capacities and feedstock-use of biofuels produced from raw materials listed in Annex IX , as is already the case in some countries.
  • There must be tougher sanctions on non-compliance.

“The EBB considers fraud an existential threat for our industry, for the functioning of sustainability verification, and for the EU’s climate ambitions. We remain committed to high standards and full compliance with the Renewable Energy Directive (RED) sustainability criteria.“

Secretary General of the European Biodiesel Board (EBB)

In its continued effort to tackle biofuels fraud, the European Biodiesel Board (EBB) has published an elaborate and ambitious proposal revising the rules on sustainable biofuels verification.

The surge of imports from South-East Asia from 2022 onwards, leading to the collapse of the EU market, has raised serious concerns in the industry on the compliance of some imports with the criteria of the Renewable Energy Directive (RED). These suspicions are sustained by the abnormal increase in both biodiesel production and waste feedstocks availability.

Ever since EBB became vocal on the issue, more and more stakeholders have joined the call for action. Members States at the Energy Council meeting on the 30th of May 2024 called on the Commission to develop “strong corrective actions to prevent the entry of fraudulent biofuels on the European market“. A leading environmental NGO in the field of transport jumped on the bandwagon requesting action, and Indonesia and Malaysia are taking measures to prevent tax fraud with exported palm oil waste feedstocks.

EBB Whistleblower Tool

Data protection information on the processing of your personal data pursuant to Art. 13, 14 GDPR

As part of the provision of the whistleblower tool, personal data is processed, both of persons who submit a report and of persons who have a connection to the reported facts, and therefore also information that relates to you. Submissions are subject to any obligations imposed on EBB or Redeker by law (e.g. request of prosecution authorities).

The European Biodiesel Board (“EBB”) has commissioned the law firm Redeker Sellner Dahs, Partnerschaft von Rechtsanwältinnen und Rechtsanwälten mbB, (“Redeker”) to set up a whistleblower tool to enable confidential and simple reporting of allegations of fraud or violations of the Renewable Energy Directive (“RED”). All information contained in the reports will be reviewed upon receipt by authorised employees of the EBB Secretariat and, in cases selected by the designated EBB employees, also by Redeker. The aim is to inform the competent audit bodies, national authorities, the European Commission and political decision-makers (e.g. members of parliament and their staff) so that violations can be detected and penalised.
